Abstract

In an attempt to protect whales in the Great Southern Ocean, the Australian Government has initiated proceedings against Japan in the International Court of Justice. This note provides an overview of Australia’s laws regarding whaling in the waters off Antarctica and the Australian Whale Sanctuary, the 2008 Japanese whaling case and the new proceedings in the International Court of Justice. To provide a broader context for these issues, this note also explores the issue of cruelty in relation to whaling.
