Abstract

This paper discusses major legal and economic trends in the agricultural seed industry, and their implications for the U.S. and world food system. It discusses seed patents, genetic engineering and seed innovation, the growing proprietary control of seed resources, the consolidation of the seed industry, and seed industry market power. It provides an overview and analysis of relevant intellectual property and antitrust laws and issues related to seed resources. It concludes by posing key questions related to future of the seed industry, and the potential implications for agriculture and the food system. This paper was prepared in 2012 as a project for the University of Wisconsin Law School Government and Legislative Clinical Program.
