Abstract

With a view to the Proposal for a recast of the Brussels I Regulation, in this chapter the Author analyses the forum non conveniens discretion left to Member States’ courts within the EU judicial area when it comes to defendants domiciled in third States, notably in light of the ECJ’s Owusu judgment and Lugano Opinion.
