Abstract
Professor Linda A. Malone explores the legal dilemma of Guantánamo detainees in this article written for the Criminal Law Forum. The Executive’s detention powers interplayed with the Judiciary’s habeas powers decided the setting for the commission proceedings off the Guantánamo detainees. This article examines the ways that Congress and the US courts have shaped the law regarding Guantánamo detainees. And, examines the Presidential policies set by Bush and Obama.
