Abstract

Professor Linda Malone explores the future of transferable development rights (TDRs) in the Supreme Court in this article. The utilization of TDRs to protect land use actions from taking challenges is growing, yet the Supreme Court has hitherto to address whether government regulation that would constitute a taking of personal property sans just compensation could be salvaged with TDRs.
