Professor Linda Malone examines the total maximum daily load (TMDL) program of section 303(d) of the Clean Water Act in this article. The TMDL program presently seems further from implementation than it has in its thirty years of making. In the distant past, it has been met with political resistance and opposition, whereas in 1972 government powers insisted on the program. This article, will explore state criticisms of the TMDL program and it’s checkered past.
