Abstract

El derecho global puede analizarse a la luz de las categorías jurídicas de derecho global cuasi-privado, derecho público global y derecho global penal. En consecuencia, los bienes jurídicos globales pueden clasificarse en privados, públicos y penales. Todos ellos están subsumidos en el derecho constitucional global, que ha emergido a raíz de proceso de constitucionalización del derecho internacional, por medio del cual los bienes del constitucionalismo están siendo aceptados de manera creciente en el plano global. La introducción de las categorías de derecho administrativo, penal y constitucional en la esfera internacional contribuye a identificar los instrumentos, instituciones y principios jurídicos apropiados para las diferentes ramas del derecho. El paradigma de los bienes se centra en la legitimidad por resultados o de salida del ordenamiento jurídico global (output legitimacy). Al resaltar la necesidad de la participación del público global, el constitucionalismo global añade la dimensión de la legitimidad por entrada (input legitimacy).

Global law can be analysed along the lines: global quasi-private law, global public law, and global criminal law. This implies that global legal goods can be divided into private law goods, public law goods, and criminal law goods. The overarching legal framework for these legal goods is global constitutional law. This law has emerged through a process of "constitutionalisation" of international law, by which the "goods" of constitutionalism (such as rule of law, human rights, democracy, and solidarity) have been acknowledged and have been creatively acknowledged on the global plane as well. The introduction of the categories of administrative, criminal, and constitutional law into the international sphere is useful in espistemic and practical terms, inter alia because it helps to identify the appropriate types of legal instruments, institutions, and principles for the different branches. The analytical added value of the concept of "global legal goods" is doubtful because it does not solve any operational question. Moreover, the "goods"-paradigm focuses on the output legitimacy of the global legal order. By highlighting the need for the global public’s participation, global constitutionalism adds the input dimension.
