La minería desempeña un importante papel en la economía de Canadá, y al igual que en Perú, las compañías mineras canadienses deben tener en cuenta los aspectos medioambientales y los intereses de las comunidades indígenas. El presente artículo describe cómo consideran las cortes canadienses la consulta y el acuerdo en los casos de dos grupos de pueblos indígenas: los que no tienen demarcadas sus tierras y los que han suscrito tratados territoriales modernos. El artículo concluye con la comparación entre el proceso seguido por la compañía BHP Diamonds en Canadá y el proceso que seguiría la BHP Billiton en Perú.

This study, in Spanish, compares the application of free prior informed consent (FPIC) principles in Canada and Peru. It takes the case of BHP Billiton, and Australian company active in both Canada and Peru. In Canada, the company was required to go through a two and half year process for approval of an expansion of a diamond operation. The process including consultation with communities and pass through a review of a tribunal that included both government and indigenous representatives. In Peru steps have been taken to provide a legislative basis for consultation processes. Unfortunately, the time lines are short and the process is not clear, but it appears that even the most expansive reading of the legislation will result in a process that is about eight months long. There is no participation of indigenous peoples in the decision-making process.
