Abstract

A partir de la década de los ochenta, las relaciones el Estado francés y las manifestaciones de libertad religiosa, que habían permanecieron relativamente estables, adquieren una nueva forma de litigios, sobre todo a través de los llamados casos de navegando del velo a escuela. Se observa como, en un primer momento, la respuesta de las autoridades ante este fenómeno vino marcada por un lado, por un respecto real para con las personas usuarias del servicio público, y por otro lado; por la firmeza contra los agentes de la administración pública.

Más tarde y coincidiendo con el inicio de los años 2000, comienzan a ser cada vez más frecuentes las manifestaciones radicales de pertenencia religiosa, unidas a la voluntad política de afirmar los principios republicanos que incluyen el principio de laicidad.

Este desarrollo ha dado lugar a un endurecimiento del discurso legislativo, que ha pasado del control de la manifestación de la pertenencia religiosa del alumnado en las escuelas, hasta y de manera más recientemente, un control de la vestimenta de cualquiera persona en el espacio público.

Así pues, debemos interrogarnos respecto a la necesidad y la proporcionalidad de las limitaciones que conlleva esta esta Ley con respecto a las libertades religiosas, de expresión y al respecto de la vida privada.
