Spanish Abstract: El texto cuestiona el sistema jurídico brasileño que, basado en una concepción extrema del principio de publicidad en el derecho procesal, no es capaz de establecer una distinción entre los actos judiciales, los documentos y escritos producidos por las partes, con el fin de acceder a la información procesal, y que, en la práctica, pone en riesgo la protección de los datos personales y de aquellos que se refieren a la seguridad de la sociedad y del Estado, en cuanto se encuentren judicializados.

English Abstract: This paper raises questions about the Brazilian legal system, which takes to an extreme the constitutional principle (the publicity principle) requiring publication of legal cases, and is unable to properly distinguish between the need to publish judicial decisions, and the publication of documents and texts produced by the parties, thus en-dangering the protection of personal data, and representing a possible security risk to the State and society as a whole.
