Liabilities of Governmental Entities for Damages Suffered by Officers and Employees

Abstract

In Spanish law, contract liabilities and torts can only concur among the same parties in exceptional cases. One of them is the field of liabilities of governmental entities, in which a tort action is compatible with contractual or statutory compensation for liabilities granted to officers or employees of governmental agencies. This generates some problems, as both address the same damages or injuries. The author states that tort actions in these cases should be restricted and that the best way to achieve it is by legislative action. Therefore, he proposes a new statute on this matter and gives some clues of its possible content.
