Innovation in the Justice Sector: What Makes it Happen?

Abstract
In this paper, we explore what may trigger successful innovation in mechanisms providing accountability before third parties. It discusses factors that foster innovation within the public sector according to two literature reviews that are often cited. These data are linked to key findings from the literature on legal reform and legal innovation, as well as to descriptions of successful innovations in the justice sector. The main result of this paper is thus a list of factors fostering innovation tailored more precisely to the justice sector. Some of these factors may be more easy to overcome in the justice sector than in the public sector more in general, other ones may provide bigger bottlenecks for innovation; bottlenecks that can be turned into opportunities. We conclude by exploring where the biggest bottlenecks and opportunities for innovation in the legal sector may be located.
