Abstract
This article aims to analyze the concept of communication to the public through previous case-law of the Court of Justice of the EU, to elaborate on its development, to assess its definition and to provide a standing the CJEU may take in a preliminary reference in case C-466/12 Svensson which is dealing with a (decade old) question whether linking to a copyright-protected content constitutes a communication to the public.
