Abstract

This paper argues that the Constitution of the Commonwealth of Puerto Rico, which entrenches the island's relationship with the United States, fails to meet basic democratic criteria. Since the constitution does not allow for the legal termination of this (undemocratic) relationship, the paper argues that an extra-constitutional exercise of constituent power would be justified in order to bring about a new constitutional order.
