Abstract
This paper analyses the theoretical and practical aspects of Dispute Avoidance Processes (DAPs) and considers why Australia has been slow to embrace DAPs. It examines the inclusion of DAPs in standard form contracts in other jurisdictions and considers whether it is time for Australia to incorporate DAPs into standard form construction contracts.
