Abstract

This consders the circumstances in which a tenant could set-off a liability against an assignee of the reversion, when the right to set off had accured in relation to the original landlord. The issue reminds us that England & Wales does not have a coherent code of landlord and tenant obligations, but a patchwork of contractual and proproetary rules.
