Abstract
The Freedom of Navigation in conjunction with the Principle of Equality of sovereign states ensure the exclusivity of Flag State Jurisdiction over vessels carrying its nationality, thus meaning that only the Flag State has the right to exercise control and enforce its laws. However, under specific and exceptional circumstances this exclusivity can be sidestepped and third states may interfere with vessels of another state, primarily, on the high seas.
