Recently, the labour enforcement authorities under the Contract Labour (Regulation & Abolition) Act, 1970 (hereinafter “1970 Act”) have initiated prosecutions against Heads of Functional Departments of the factories of Public Sector Undertakings for not obtaining registration under the 1970 Act. The allegation is that each department of the factory is a separate establishment and therefore registration has to be obtained separately for each such individual department. This short paper analyses the legal position and argues that the view taken labour enforcement authorities is not correct.
