Abstract

Este artículo revisita el concepto de igualdad soberana de los Estados frente a los desafíos que provienen de las lógicas de globalización, democratización y privatización del derecho internacional. El autor sostiene queel principio de igualdad soverana, una ficción jurídica constitutiva del derecho internacional, sigue teniendo un significado normativo relevante en la soliciedad internacional contemporánea como puente que conecta Estados desiguales.

This article revisits the concept of sovereign equality of States and considers several challenges to such principle as a result of logics of globalization, democratization and privatization of international law. The article argues that the principle of sovereign equality, a constitutive legal fiction of international law, still has a significant normative function in present international law and society as a bridge connecting unequal States.
