Reflexiones Económicas Alrededor De Los Avances En El Régimen De Integraciones Empresariales Presentes En La Resolución 12193 De 2013 De La Superintendencia De Industria Y Comercio (Economic Analysis of the Advances in the Regime of Business Integration in the Resolution 12193 of 2013 of the Superintendency of Industry and Commerce)

Abstract

El análisis económico en materia de competencia y en especial en el estudio de integraciones va más allá de los aspectos cuantitativos, al brindar un marco conceptual adecuado y flexible para analizar los mercados y entender los efectos e implicaciones del comportamiento empresarial. La expedición de la Resolución 12193 de 2013 por parte de la Superintendencia de Industria y Comercio –SIC– refleja la creciente importancia del análisis económico en las diferentes actuaciones administrativas para la autoridad de nacional de competencia. En este artículo se señalan los avances de la Resolución 12193 de 2013 expedida por la Superintendencia de Industria y Comercio, las cuales son analizadas a la luz de los planteamientos de Coase y su obra sobre el Costo Social.

The economic analysis of competition and especially in merger studies goes beyond quantitative aspects, recognizing that it gives a conceptual framework to analyze markets and to understand the effects and implications of the Enterprise behavior. The issue of the Resolution 12193 of 2013 by the Superintendence of Industry and Commerce reflects the progressive importance of the economic analysis in the different administrative acts in charge of the national competition authority. In this article it is presented the Colombian merger regime novelties and those are understood under the scope of Coase’s view proposed in his book the Social Cost.
