Abstract

While collaborative public procurement can, under certain circumstances, result in overall economic efficiencies; such collaboration amongst dominant market players can sometimes raise significant anti-trust and other competition concerns. This short working paper contains a preliminary exploration of important issues of intersection between public procurement rules on collaborative procurement on the one hand with competition law issues on the other. The two important frameworks studied herein are the US and the EU frameworks on collaboration, together with a comparative review of the Indian position.
