Abstract
In response to Suzanna Sherry's article, "Why We Need More Judicial Activism," this Comment suggests, based on constitutional history, that judicial "activism" is most appropriate in situations in which the legislature is likely to have acted out of passion or prejudice rather than after considered deliberation.
