Abstract
The paper is aimed to explore the problems deriving from the product liability in licensing agreements, with focus to the trademark licensor who is not a manufacturer of a product; and ways how to minimize their exposure by contractual provisions and in frames of competition rules. This issue will be dealt from the perspective of two jurisdictions: the United States (US) and the European Union (EU).
