Abstract
近年来中国官方对20世纪末的司法改革路线进行反思并采取了一系列应对措施。本文就这 一 现象进行深入分析,认为近年的司法实践转向(譬如调解的东山再起)尽管与全球性趋势(包括美国的“逆法而动”现象)有相似之处,却明显是为了应对中国特色制度下社会稳定问题的内部政治反应,是 一 种过度重视“维稳”的自上而下的反应。它有很大的风险,即短期“维稳”可能会牺牲长期的国家利益,造成恶劣的后果 一 司法制度的逐渐虚弱甚至国家的动荡。
In recent years, Chinese authorities have launched a reconsideration of legal reforms they pursued in the late 20th century. This article analyzes this shift in policy, and the measures that state authorities have taken in response.
Changes in the direction of Chinese state legal reform efforts (such as the revival of mediation) share some similarities with developments in other countries through the world (such as the American "turn against law.")
But this article concludes that the Chinese shift against law is a distinct domestic political reaction to building social stability pressures in the Chinese system, representing a problematic top-down approach focused on "stability maintenance."
This article argues that this development carries serious risks. The focus on maintaining social stability in the short term may be sacrificing long-term national interests and generating severe long-term effects undermining Chinese legal institutions and destabilizing China.
