Abstract

Il presente articolo rappresenta la seconda parte di un lavoro avente ad oggetto l'analisi dettagliata del reato di conspiracy come previsto dalla common law. Questo secondo articolo si occupa della struttura della fattispecie. In particolare, l'autore analizza la definizione e la natura del reato, l'elemento oggettivo e quello soggettivo del delitto, il requisito della "collaborazione criminale" come elaborato alla luce della "Pinkerton rule", nonché le norme federali relative alla conspiracy.

This paper represents the second part of a work that thoroughly analyses the common law offence of conspiracy. This second paper deals with the structure of the offence. In particular, it focuses on its definition and juridical nature (inchoate offence); the actus reus (the agreement and the overt act); the mens rea; the necessity of a criminal collaboration, aiding and abetting (with a specific reference to the Pinkerton rule); the U.S. Federal Conspiracy Law.
