Abstract

This essay examines Justice Antonin Scalia and Professor Bryan A. Garner’s Reading Law in the context of patent law. In it, I explore the relationship between textualism and two facets of patent law: statutory interpretation and claim construction. This examination illustrates some of the strengths and limitations of Justice Scalia and Professor Garner’s approach to interpreting legal texts.
