Abstract

In 2000, Touro Law Center held a Section 1983 Civil Rights Litigation Symposium, and during that program, Professors Martin A. Schwartz & Erwin Chemerinsky engaged in a free-flowing discussion about the element of state action required to be proven in Section 1983 litigation. This Article records their discussion on this topic. In their discussion, the authors analyze the U.S. Supreme Court case law and other important, relevant legal decisions on this issue.
