Abstract
French Abstract: Dans "Relire van Gend en Loos", J'ai tenté de renouveler l'analyse de l'arrêt de 1963 de la Cour de justice. Les commentateurs ont surtout concentré leur analyse sur la désignation par la Cour des traités CE comme un nouvel ordre juridique; or l'arrêt a également fixé les conditions d'applicabilité directe, d'une manière qui faisait présager sa jurisprudence sur les directives, et sur l'effet direct vertical. En outre, la Cour était pleinement consciente de la conséquence nécessaire de sa décision, à savoir l'application du principe de primauté, comme elle l'a fait peu de temps après dans l'affaire Costa c ENEL.
English Abstract: In "Relire van Gend en Loos" I have attempted to renew the analysis of the 1963 ruling of the ECJ. Whereas scholars have mostly concentrated upon the novel analysis of the EC treaties as a new legal order, it is important to acknowledge that the court did establish immediately the conditions of direct applicability, in a way which made its further jurisprudence on directives, as well as its jurisprudence on vertical direct effect, fully predictable. Furthermore the court was fully aware of the necessary consequence of its ruling, i.e. applying the principle of primacy, as it would do a little bit later in Costa v. ENEL.
