Notas Sobre as Resoluções Obrigatórias do Conselho de Segurança da ONU e sua Introdução no Direito Brasileiro (Notes on the Mandatory Resolutions of the UN Security Council and on their Introduction into Brazilian Law)

Abstract

Portuguese Abstract: Principal órgão responsável pela paz e segurança internacionais, o Conselho de Segurança da ONU pode adotar resoluções de cunho obrigatório aos estados a que se destinam. Não tendo efeito direto nem aplicabilidade imediata, elas precisam ser incorporadas ao direito interno de cada país. Veiculando uma obrigação de resultado, deixam a cada jurisdição eleger os instrumentos para alcançá-lo. Sua incorporação, em alguns casos, não é suficiente para dar-lhe total cumprimento: é necessária a edição de leis complementares. No Brasil, a prevalecer a jurisprudência dominante, o iter adotado para sua incorporação pode ser tido por inconstitucional, já que não há a participação do Parlamento.

English Abstract: The Security Council is the UN organ with primary responsibility for the maintenance of international peace and security, with authority to adopt resolutions imposing mandatory obligations upon the addressed states. Lacking direct effect, they need be incorporated into the domestic law of each country. As they often impose obligations of result, they leave to each state the choice of the instruments necessary for the attainment of their objectives. In some cases, their mere incorporation is not sufficient to enforce them and the enactment of complementary legislation becomes necessary. The prevalent Brazilian case-law points to the unconstitutionality of the procedure adopted for their incorporation given the lack of Parliamentary participation.
