Abstract

Romanian Abstract: Prezentul articol este un examen al jurisprudentei române în materia interpretarii si aplicarii dreptului UE si a Conventiei pentru apararea drepturilor omului si a libertatilor fundamentale în cererile privind trimiterile preliminare. Subiectul poate declansa dezbateri aprinse cu privire la cunoasterea limitelor precum si exercitarea competentelor de catre instantele din România în materia trimiterilor preliminare, care presupune aplicarea unor norme juridice distincte - dreptul national, dreptul Uniunii Europene si Conventia pentru apararea drepturilor omului si a libertatilor fundamentale. Articolul discuta refuzul trimiterilor preliminare ale instantelor din România precum si o posibila ierarhie a normelor juridice în acest context.

English Abstract: The article discusses case law of Romanian courts concerning the interpretation and application of European Union law and the Convention for the Protection of Human Rights and Fundamental Freedoms in requests for a preliminary ruling. This subject-matter is liable to trigger a heated debate about the limits of powers and their exercise by the Romanian courts in relation to references involving the application of different legal standards - national law, European Union law and the Convention for the Protection of Human Rights and Fundamental Freedoms. The article discusses the way in which various courts of Romania have rejected such references and also a possible hierarchy of legal norms in that regard.
