Abstract

This book chapter analyzes article 8 of the Statute of the International Criminal Tribunal for the former Yugoslavia with reference to the most recent jurisprudence of the ICTY. It examines the territorial and temporal jurisdiction of the Tribunal, considering the basis for jurisdiction, the lawfulness of the exercise of jurisdiction, the scope of the territory and temporal limitations and the problem of crimes whose elements fall both within and without the territorial and temporal jurisdiction of the Tribunal.
