Abstract
Romanian Abstract: Articolul realizeaza o analiza critica a modificarilor impuse de Noul Cod de Procedura Civila potrivit caruia "judecarea cauzelor se suspendă de drept în cazul în care în care instanţa formulează o cerere de pronunţare a unei a unei hotărâri preliminare adresată Curţii de Justiţie a Uniunii Europene". Autorii analizeaza jurisprudenta romana pertinenta studiului anterioara modifcarii, dreptul comparat din state membre ale UE precum si avantajele si dezavantajele noii masuri legisative.
English Abstract: The paper critically assesses the amendments brought by the New Code of Civil Procedure, according to which "proceedings shall by stayed ex officio in case a court makes a preliminary reference to the Court of Justice of the European Union." The authors examine the relevant Romanian case law, certain issues of comparative law from the Member States of the European Union and they also consider pros and cons of the new legislative measure.
