Italian Abstract: Questo articolo mostra l'influenza di Wesley N. Hohfeld sul pensiero di J.R. Commons, uno delle figure principali del Vecchio Istituzionalismo. Sia Hohfeld sia Commons offrono un contributo nella comprensione della natura rivale delle relazioni giuridiche. L'articolo tenta di riformulare tale contributo mendicante il concetto di posizionalita' come introdotto da Fred Hirsch.

English Abstract: This work documents Wesley Newcomb Hohfeld’s influence on John Rogers Commons, one of the leading figures of Old Institutionalism. Both Hohfeld and Commons offer a contribution in the understanding of the adversarial nature of jural relations. We try to reformulate these contributions by the concept of positionality as introduced by Fred Hirsch.
