Abstract

Romanian Abstract: Articolul îşi propune să analizeze problemele care pot apărea din aplicarea şi interpretarea dreptului Uniunii Europene, mai precis în situaţia în care instanţa naţională formulează, potrivit Noului Cod de Procedura Civilă, o trimitere preliminară la Curtea de Justiţie în faza executării silite. În special, articolul va încerca să delimiteze acţiunea principiului autonomiei procedurale şi influenţa acestuia în privinţa suspendării judecăţii precum şi efectele cu privire la suspendarea cursului executării silite.

English Abstract: The paper aims at analyzing certain issues that are likely to appear in application and interpretation of European Union law, more precisely in case when, according to the new Code of civil procedure, national court makes a preliminary reference to the Court of Justice in proceedings for forced enforcement. The paper seeks especially to mark the principle of procedural autonomy and its influence in what concerns staying of main proceedings, along with effects concerning staying the proceedings for forced enforcement.
