Romanian Abstract: Articolul de faţă urmăreşte discutarea într-un context mai general a argumentelor pro şi contra recunoaşterii unui efect direct orizontal dispoziţiilor Directivei 98/59 într-un litigiu privind o concediere colectivă. Punctul de pornire al discuţiei este reprezentat de la două hotărâri relativ recente pronunţate de instanţe române în litigii privind concedieri colective operate în contextul insolvenţei societăţii comerciale: în timp ce o instanţă română a făcut aplicarea principiului stabilit în jurisprudenţa constantă a Curţii Europene de Justiţie, potrivit căruia într-un litigiu între particulari nu este posibilă invocarea efectului direct al dispoziţiei unei directive, cealaltă instanţă română s-a întemeiat semnificativ pe o hotărâre a Curţii Europene de Justiţie pentru a conchide implicit în favoarea unui efect direct orizontal într-un alt litigiu asemănător. Or, articolul urmăreşte încadrarea celei din urmă soluţii în jurisprudenţa Curţii Europene de Justiţie. Ulterior unei introduceri în context, secţiunile articolului prezintă şi discută în paralel cele două hotărâri române în contrapondere cu jurisprudenţa Curţii Europene de Justiţie. Chiar mai recent, aceasta din urmă a respins posibilitatea unei „revoluţii” în privinţa efectelor juridice ale directivei, ca act juridic al UE, în dreptul statelor membre, inclusiv în contextul în care directiva este coroborată cu o dispoziţie a Cartei drepturilor fundamentale a UE.

English Abstract: The present paper aims at discussing in a broader framework pros and cons in what concerns granting horizontal direct effect to provisions of Directive 98/59 in proceedings concerning collective redundancies. The discussion has as a starting point two rather recent judgments delivered by courts of Romania in proceedings concerning collective redundancies prompted by company’s insolvency: while a court of Romania acknowledged the principle of the settled case-law of the European Court of Justice, according to which the direct effect of a provision of a directive may not be relied on in proceedings between private parties, another court of Romania used extensively a judgment of the European Court of Justice, implicitly assuming a horizontal direct effect in similar proceedings. Yet, the paper strives to frame this latter decision in the case-law of the European Court of Justice. Following an introduction in the subject-matter, the sections of the paper present and discuss these two judgments rendered by courts of Romania in comparison with the case-law of the European Court of Justice. Even more recently, this latter rejected the possibility of a “revolution” in what concerns legal effects of directive, as legal act of the EU, in the legal system of the member states, and that concerned also the case when the directive is read in conjunction with a provision of the Charter of Fundamental Rights of the EU.
