Preluarea De Datorie În Noul Cod Civil Român (The Debt Assumption in the New Romanian Civil Code)

Abstract

Romanian Abstract: Studiul de față analizează preluarea de datorie care este o instituție reglementată în premieră la momentul adoptării noului cod civil român. Deși aceasta era și înainte utilizată în practică, practicienii făceau apel la anumite operațiuni juridice pentru a aplica preluarea de datorie, unele dintre acestea fiind încă de actualitate. După o scurtă prezentare a noțiunii, analizăm cele două forme ale preluării de datorie prevăzute de noul Cod civil român, și anume: cesiunea de datorie și contractul încheiat între creditor şi noul debitor prin care se convine preluarea datoriei, cu o atenție deosebită asupra validității, eficacității și asupra efectelor acestor procedee juridice.

English Abstract: This study examines the debt assumption that is an institution regulated expressly for the first time by the new Romanian Civil code. Although it was used before in practice, legal practitioners had to make use of certain legal operations to apply the assumption of debt, some of them still being valid. After a brief overview of the concept, we analyze the two forms of the debt assumption, by contract between the original debtor and a new debtor, or by contract between de creditor and a new debtor, focusing on the validity, effectiveness and effects of these legal proceedings.
