Abstract

India currently has venture capital funds, alternative investment funds, private equity funds, real estate investment trusts, securitisation trusts, special situation funds, asset reconstruction trusts, and so on. And yet, with absolutely no clarity on tax principles. There are as many tax principles as are funds existing in India. In a recent ITAT ruling of India Advantage Fund, the judiciary has provided the much needed clarity on fund taxation.
