Die Aristotelische Ursachenlehre Als Wissenschaftstheoretisches Fundament Der Juristischen Gesetzesexegese (The Aristotelian Theory of Four Causes as the Scientific Foundation to Interpret German Laws)

Abstract

German Abstract: Schon im ersten Semester lernen Studierende der Rechtswissenschaften mit grammatikalischer, historischer, systematischer und teleologischer Auslegung die vier Canones der Gesetzesexegese kennen. Setzen sie sich näher mit der Rechtsmethode auseinander, stoßen sie etwaig auf weitere Auslegungsarten, welche die Anzahl der Canones erhöhen soll. Warum genau diese vier Canones die Gesetzesexegese bestimmen und wer sie maßgeblich beeinflusste, wird in der Methodenliteratur indes selten diskutiert. Wenn überhaupt, werden die ersten drei Auslegungsarten ideengeschichtlich auf Friedrich Carl von Savigny zurückgeführt.

In der Tat lassen sich die vier Canones der Gesetzesexegese aber auf die für die Physik geschaffene aristotelische Vierursachenlehre zurückführen. Abgesehen von der Klarstellung der Ideengeschichte, kann diese Erkenntnis neue Forschungsfelder für die Aristotelesforschung, Jurisprudenz und anderen Wissenschaften (bspw. der Theologie, Psychologie oder Germanistik) – auch in Interdisziplinarität – eröffnen, die wissenschaftstheoretische Fundiertheit der juristischen Gesetzesexegese belegen sowie potentielle Grundlage für eine allgemeine Hermeneutik sein.

English Abstract: In the first semester students of German law learn that there are four canones to interpret the law: grammatical, historical, systematic and teleological interpretation. If they look more closely, they might encounter further types of interpretation, that could increase the number of the canones.

However, why exactly these four types determine the interpretation of laws and who significantly influenced them, are two rarely discussed topics in the methodical literature. If anything, the first three types of interpretation are attributed to Friedrich Carl von Savigny.

In fact the four canons of legal exegesis can be traced back to Aristotle's four causes doctrine created for physics. Apart from the clarification of the history of ideas, this knowledge can open new research fields for Aristotelian research, law and other disciplines (eg theology, psychology or science of literature) – even in an interdisciplinary way – prove the epistemological soundness of the legal laws of exegesis as well as form a potential basis for a general hermeneutics throughout the disciplines.
