Abstract

Portuguese Abstract: Nos últimos anos, o Supremo Tribunal Federal apresentou modificações radicais na forma de seus julga- mentos. Seja pela adoção de técnicas metodológicas pretensamente racionais, seja pela construção de me- canismos cada vez mais centralizadores das decisões constitucionais em suas mãos, a verdade é que a cul- tura constitucional brasileira está em uma forte transição em direção ao ativismo judicial. Nesse contexto, aparece a discussão sobre o mandado de injunção, instrumento interessantíssimo da Constituição Federal de 1988, que, após anos de esvaziamento de suas potencialidades de garantia de direitos e liberdades, aparece agora como um importante argumento para se pensar o papel da Corte Constitucional brasileira. A questão é como refletir sobre esse instrumento dentro de uma lógica argumentativa que parece enfraquecer nosso sistema concreto de constitucionalidade, o que se dá pela tentativa de suscitar a eficácia erga omnes em suas decisões, aspecto que se torna fortemente questionável diante da interpretação hoje pro- movida pelo Supremo Tribunal Federal após o julgamento dos MIs 670, 708 e 712 em 2007. Se o manda- do de injunção é um instrumento relevante para consolidar direitos e liberdades, quer-se saber como, legi- timamente, essa prática pode ser promovida pela jurisdição sem que isso implique um ataque ao princípio da separação de poderes.

English Abstract: In the last years, the Brazilian Federal Supreme Court (STF) has gone through radical transformations in its decisions. Either through the adoption of supposedly rational methodological techniques, or through the construction of even more centralizing mechanisms of constitutional decisions in its hands, the truth is that Brazilian constitutional culture is in strong transition toward judicial activism. In this context, the discussion of the Injunctive Writ, a very interesting instrument of the Federal Constitution of 1988, which, after long years of being unable to reach its potentialities of guaranteeing rights and freedoms, appears now as an important argument to think of the Brazilian Constitutional Court’s role. The question is how to reflect upon this instrument within an argumentative logic that seems to weaken our concrete system of judicial review, which happens by attempting to set out erga omnes effect in its decisions, something really questionable in the face of STF’s actual interpretation after its decision on MIs 670, 708 and 712 in 2007. If the Injunction Writ is an instrument relevant to consolidate rights and freedoms, we are willing to know how, legitimately, this practice can be promoted by adjudication without infringing the principle of separation of powers.
