Abstract

On 10 January 2001, the “new” Rights in Water and Irrigation Act 1914 (WA), as substantially amended by the Rights in Water and Irrigation Amendment Act 2000 (WA), and the Rights in Water and Irrigation Regulations 2000 came into operation. This article reviews key elements of the new legislation and assesses the legislative reforms that have eventuated, including the basic rights and duties of the Crown and private persons in respect of water resources; administrative mechanisms for government consideration of environmental factors in managing the sustainable use of water resources; and the creation of tradeable entitlements in water resources.
