Abstract

The paper takes a brief introductory examination of the two prevalent notions of corporate rescue in England and Wales: the business rescue and company rescue perspectives. It argues that the core difference between both concepts lies in the nature of the sale. In the latter, a hypothetical sale is made to the buyer, while the former requires an actual sale. It argues that our focus should be on achieved sustained rescue outcomes instead.
