Genocidas Ir Baudžiamoji Teisė: Nacionalinės Ir (Ar) Tarptautinės Teisės Apibrėžtys (Genocide and Criminal Law: National and International Definition)

Abstract

Lithuanian Abstract: Straipsnyje analizuojama genocido nusikaltimo sudėties apibrėžtis tarptautinėje teisėje ir Lietuvos nacionalinėje teisėje, atskleidžiama Lietuvos istorinės patirties nulemta problematika vykdant asmenų, atsakingų už tarptautines nusikalstamas veikas sovietinės okupacijos laikotarpiu, baudžiamąjį persekiojimą. Straipsnyje taip pat pateikiama Lietuvos teismų praktikos nagrinėjant baudžiamąsias bylas, kuriose asmenys pripažinti kaltais dėl genocido vykdymo, analizė prisiimtų tarptautinių įsipareigojimų kontekste.

English Abstract: The article analyzes the definition of genocide in national Lithuanian law and international law as in the criminal code of Lithuania genocide is defined in broader terms where the list of protected groups also embraces social and political groups. Therefore special attention is given to the problem of prosecuting for genocide in Lithuania having in mind the historical circumstances when under Soviet occupation mass killings and deportations under inhume conditions were officially based on social and political membership. The case law of the Supreme Court of Lithuania is also reviewed in the light of the international obligations of Lithuania. The article was prepared while the petition concerning the constitutionality of the broader definition of genocide was pending before the Constitutional Court of the Republic of Lithuania.
