Abstract

Russian Abstract: Конституционная идея разделения властей имеет многовековой опыт существования и дошла до наших дней в виде триединой метафоры правления со свойственным ей разделением на три ветви власти. В процессе исторического развития видоизменились государственные и общественные институты, а значит, преобразовались и базовые идеи, которые мы именуем основами конституционного строя. В этой связи в статье последовательно анализируется доктрина разделения властей, но, применительно к современным условиям, выявляются новые аспекты функционирования данного принципа, а также приводятся предложения по реализации и совершенствованию конституционной идеи разделения властей в федеративном государстве.

English Abstract: The constitutional idea of separation of the powers has centuries-old experience of existence and reached in the form of a triune metaphor of board with division peculiar to it into three branches of the power up to now. In the course of historical development the state and public institutes changed, so, also basic ideas which we call bases of the constitutional system were transformed. In this regard in article the doctrine of division of the authorities, but in relation to modern conditions, is consistently analyzed, new aspects of functioning of this principle come to light, and offers on realization and improvement of the constitutional idea of division of the authorities in a federal state are also provided.
