Abstract

Culture war battles over marriage and family have impacted a number of legal fields, but most particularly in constitutional law which is the focus of this article. Discussing the appropriate venues and methods for deciding controversial public policy issues, it examines the sources of individual rights under the Constitution, and places those rights in a culture wars context.
