Comments on the High Court of Australia decision in Kennon v Spry concerning, in relation to discretionary trusts for the purpose of property settlement under the Family Law Act 1975 s.79, the scope of "control" that an appointor may exercise over the working of a trust, or a trustee may exercise by potentially appointing to one of a large class of beneficiaries, in terms of "ownership" of the underlying trust assets.
