Litigating in the Qatar International Court (لتقاضي في محكمة قطر الدولية)

Abstract

English Abstract: The Qatar International Court, and more specifically the Civil and Commercial Court, is designed to attract international business and to make Qatar a world capital for investment. The Court achieves this by assuring justice and an expeditious decision-making process while observing the best international practices. The Court, an institution separate from Qatar’s Sharia and civil courts, uses a simplified model of the United Kingdom’s evidentiary and procedural rules. Some of the world’s most respected judges preside in this Court. This article was prepared in the hopes that once practitioners become familiar with the Qatar International Court’s procedures and Qatari law, they will, insha’Allah, take advantage of this extraordinary forum, where they will receive a welcoming as-salamu alaykum from the Court and its expert staff.

Arabic Abstract: محكمة قطر الدولية، وبشكل أكثر تحديدا المحكمة المدنية والتجارية، وتهدف إلى جذب الأعمال التجارية الدولية، وجعل قطر عاصمة العالم للاستثمار. تحقق المحكمة بذلك عن طريق ضمان العدالة وعملية صنع القرار على وجه لسرعة مع مراعاة أفضل الممارسات القانونية الدولية. المحكمة، وهي مؤسسة مستقلة عن المحاكم المدنية ومحاكم الشريعة القطرية، تستخدم طريقة مبسطة من قوانين الاثبات والقوانين الإجرائية للمملكة المتحدة. ويشرف على هذه المحكمة مجموعة من ابرز القضاة المحترمين في العالم. وقد أعدت هذه المقالة على أمل أن عندما يصبح الممارسين على دراية بإجراءات محكمة قطر الدولية والقانون القطري، سوف، إن شاء لله، يستفيدون من هذا المنتدى الاستثنائي، حيث سيحصلون على الترحيب "السلام عليكم" من المحكمة والموظفين ذوي الخبرة. شكر ا.ً
