Abstract

Spanish Abstract: Este trabajo se centra en mostrar la comprensión clásica, el estado actual y algunos aspectos articulares de la distinción entre el régimen reparatorio contractual y el extracontractual, analizando los problemas que plantea y que han conducido a una revisión de la materia en la experiencia comparada, invitando a una reflexión seria del tema orientado por la única perspectiva que justifica la existencia de un sistema de responsabilidad civil: la protección de la persona.

English Abstract: This work focuses in the classic understanding, [i]statu quo[/i], and some key topics of the differentiation between contractual and non-contractual reparatory systems, analyzing the problems posed by it -problems that have led to a review of the matter in the comparative experience- and proposing a serious reflection on this issue, led by the only view that justifies a civil liability system: the protection of the person.
