Abstract

Does the CJEU have a mission to accomplish towards the apparently pressing topic of simplification of EU legislation and burden reduction? The following paper strives to discuss few issues of this vast field having as a starting point the principle of institutional balance between the CJEU and the EU legislator. Some recent examples from the CJEU’s case law will be considered.
