Abstract

Romanian Abstract: Finalul celui de-al doilea război mondial a marcat un moment important în dezvoltarea modului de relaţionare a statelor. Însă, a adus şi o schimbare asupra modului de aplicare a normelor dreptului internaţional. Până la apariţia Tribunalului Militar Internaţional de la Nurenberg, niciun oficial de rang înalt nu fusese tras la răspundere pentru comiterea unei crime internaţionale. Momentul Nurenberg a reprezentat începutul dreptului penal internaţional însă de la terminarea proceselor liderilor nazişti şi până în prezent niciun înalt oficial al unui stat nu a mai fost tras la răspundere pentru comiterea crimei de agresiune. Această situaţie poate fi schimbată de către Conferinţa de revizuire a Statutului Curţii Penale Internaţionale, ce a avut loc la Kampala în 2010, ce a introdus art. 8 bis ce defineşte crima de agresiune.

English Abstract: The end of the Second World War marked a milestone in the development of international relations. However, it also changed the application of international law. Until the advent of the International Military Tribunal at Nuremberg, no senior official had been held accountable for committing an international crime. The Nuremberg Trials represent the beginning of international criminal law but after the completion of the Nazi leaders trials up to present time, no high ranking state official has been held accountable for the crime of aggression. This situation can be changed by the Review Conference of the Rome Statute of the International Criminal Court, held in Kampala in 2010, which introduced article 8 bis that defines the crime of aggression.
