Abstract

Romanian Abstract: Înţelegerile anticoncurenţiale sunt realizate de cele mai multe ori de către întreprinderi care interacţionează frecvent în cadrul activităţilor economice pe care le desfăşoară. Chiar dacă unele dintre înţelegerile încheiate între întreprinderi sunt necesare bunei desfăşurări ale activităţilor economice şi aduc beneficii şi consumatorilor fiscali, uneori agenţii economici încheie înţelegeri ce aduc prejudicii economiei şi implicit consumatorilor (înţelegeri anticoncurenţiale).

Detectarea unor astfel de comportamente cade în răspunderea autorităţilor de concurenţă din întreaga lume. Acestea utilizează fie probele directe, obţinute în general în urma inspecţiilor inopinate, fie prin probe indirecte rezultate în general prin utilizarea modelelor analitice de depistare a comportamentelor anticoncurenţiale. Aplicarea eficientă a acestora conduce la depistarea cartelurilor şi la crearea unui mediu concurenţial sănătos.

English Abstract: Anti-competitive agreements are usually made by undertakings that interact frequently within the economic activities they carry out. Even though some agreements between undertakings are necessary for the good of their businesses and get benefits for the final consumers as well, sometimes, some economic operators conclude secret agreements that are harmful to the economy and to the consumers as well (anti-competitive agreements).

Detecting such behaviors is in the responsibility of the worldwide competition authorities. They are utilizing either direct evidences, got through down raids, or through indirect evidences, obtained by utilizing analytical methods for detecting anti competitive behaviors. Effective application of these methods leads to detecting cartels and to create a healthy competitive environment.
